Presidential Pardon
PRESIDENTIAL PARDON
So, you do not qualify for a criminal record expungement. Is this the end of the road?
No, absolutely not.
Section 84(2) of the present Constitution, which contains a list of powers conferred on the President, provides that the President is responsible for, among others, “pardoning and reprieving offenders and remitting any fines, penalties or forfeitures”.
Presidential Pardons are very complex and if you fail to convince the President with a very strong motivation to support your application, your prospect of success is almost zero.
Any client opting for this route must realise from the start that applications like this take approximately 2 years to finalise. Ultimately the application will end up on the President’s desk who has the final say. A pardon is discretionary henceforth we cannot provide any guarantees in this type of application.
Our services include:
- Groundwork and background investigations for the application
- Application drafting
- Ongoing monitoring of the application
Through our relationships with some of South Africa’s top legal professionals, we can also arrange High Court Applications, should it be required.
